Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and SafeMeet LLC ("SafeMeet," "we," "us," or "our") governing your access to and use of the SafeMeet mobile application and the website at safemeet.space (together, the "Service"). By creating an account, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
PLEASE READ SECTIONS 6 (NO GUARANTEE / NOT EMERGENCY SERVICES), 11 (DISCLAIMERS), 12 (LIMITATION OF LIABILITY), 13 (INDEMNIFICATION), and 15 (BINDING ARBITRATION & CLASS-ACTION WAIVER) CAREFULLY — THEY LIMIT OUR LIABILITY AND AFFECT YOUR LEGAL RIGHTS.
1. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to create an account. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
2. What SafeMeet Is
SafeMeet is a consumer personal-safety aid that provides features such as live location sharing, scheduled check-ins, Follow Me Home, distress alerts, optional audio recording, and SMS fallback. SafeMeet is not a security service, a monitoring service, a medical device, or an emergency-response provider, and it does not contact 911 or any public-safety answering point on your behalf.
3. Your Account
You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure.
4. Acceptable Use
You agree not to: use the Service to harass, stalk, surveil, or harm any person; add a "trusted contact" without their permission; record any person unlawfully; reverse engineer, scrape, or disrupt the Service; or use it in violation of any law. You are responsible for your conduct and your content.
5. Audio Recording & Consent — Your Responsibility
Audio recording is optional and user-controlled. Recording laws vary by jurisdiction, and you are solely responsible for ensuring your use complies with all applicable wiretapping, eavesdropping, and consent laws. SafeMeet does not provide legal advice and assumes no responsibility or liability for your use, or misuse, of any recording feature, including any clip you capture, store, share, or rely upon.
6. No Guarantee · Not a Substitute for Emergency Services
The Service depends on factors outside our control, including your device, battery, operating-system behavior, cellular and data networks, GPS accuracy, third-party push and SMS providers, and your trusted contacts' availability and response. We do not warrant or guarantee that any location update, check-in, alert, recording, or message will be timely, accurate, delivered, received, or acted upon.
SafeMeet is not a substitute for calling 911 or contacting professional emergency, medical, law-enforcement, or security services. In an emergency, contact those services directly. Do not rely on SafeMeet as your sole means of obtaining help. You assume all risks associated with your meetings, travel, and activities, and with your reliance on the Service.
7. Subscriptions, Billing & Refunds
Core features are free. Premium ("Elite") and SafeMeet for Teams plans are paid. In-app purchases are billed through your App Store account under the App Store's terms; web and Teams purchases are processed by a third-party payment processor. Paid subscriptions auto-renew until cancelled, and you may manage or cancel through your App Store account settings or the applicable billing portal. Except where required by law or by App Store policies, payments are non-refundable. Prices and features may change on prospective notice.
8. SafeMeet for Teams
Organizations may purchase license keys that grant members Elite access for a defined period. The organization is responsible for distributing keys only to authorized members and for its members' use. License keys are single-user and non-transferable; access ends when the license period or organization subscription ends.
9. Intellectual Property
The Service, including its software, design, trademarks, and content, is owned by SafeMeet LLC or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. You retain rights to content you create; you grant us a license to host and process it as needed to operate the Service.
10. Third-Party Services
The Service relies on third parties, including the App Store, cellular carriers, mapping providers, and our infrastructure, authentication, messaging, and payment processors. We are not responsible for, and disclaim all liability arising from, the acts, omissions, availability, or performance of any third party.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEMEET DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ALERTS, LOCATION DATA, OR RECORDINGS WILL BE DELIVERED OR ACCURATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEMEET LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY, EMOTIONAL DISTRESS, PROPERTY DAMAGE, OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY FAILURE OR DELAY OF AN ALERT, LOCATION UPDATE, RECORDING, OR MESSAGE, OR ANY ACT OR OMISSION OF A THIRD PARTY OR TRUSTED CONTACT — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in such cases our liability is limited to the maximum extent permitted by law.
13. Assumption of Risk & Indemnification
You acknowledge that meeting people, traveling, and relying on technology carry inherent risks, and you assume those risks. You agree to indemnify, defend, and hold harmless SafeMeet LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your recordings, your interactions with others, or your violation of these Terms or any law.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including 5, 6, 9, 11–13, and 15) will survive.
15. Dispute Resolution · Binding Arbitration · Class-Action Waiver
Please read this section carefully — it affects your legal rights. Except for small-claims matters and requests for injunctive relief to protect intellectual property, you and SafeMeet agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You and SafeMeet waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of arbitration by emailing hello@safemeet.space within 30 days of first accepting these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 15. Subject to Section 15, the state and federal courts located in Maryland will have exclusive jurisdiction over any matter not subject to arbitration, and you consent to venue there.
17. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
18. Miscellaneous
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and SafeMeet regarding the Service.
